DSK lawyers represented one of the leaders of the European fuel sector in a dispute before the Court of Arbitration for Internet Domains. The case concerned the unfair practices of a business partner who in bad faith registered an Internet domain identical to our client’s brand.
The opponent’s action was in the nature of a “deceitful acquisition” – its purpose was to block the Client from using the domain and to extort a high remuneration for its repurchase.
The DSK Law Firm team adopted a multi-faceted litigation strategy. Before the Court, we successfully demonstrated that the opponent’s action constituted trademark infringement and infringement of the right to the company. We also proved that the behavior exhausted the elements of an act of unfair competition.
Our argument was fully shared by the court, effectively protecting the oil giant’s image and digital assets.
