Marta Dziewulska, Jędrzej Witaszczak and Wiktoria Zielińska helped the Client implementing the project in accordance with the FIDIC contractual conditions to introduce a Sub-Clause 13 Amendment to the Contract and obtain additional remuneration in the amount of approx. PLN 0.5 million.
Negotiations with the Contract Engineer and the Contracting Authority on the legitimacy of the Change, which included the execution of a replacement and expanded scope of work for the technical building, were not easy. The Contract Engineer and the Investor argued that the scope of the disputed work falls within the scope of the Contract and should be included in the Contract Price.
In the end, the argumentation we presented, which included not only legal but also technical analysis, was accepted by the other side.
In particular, the Contract Engineer and the Contracting Authority were convinced by the detailed analysis of the PFU and the properly prepared proposal for the Change, which ultimately made it possible to obtain additional compensation for the Client.
