In this episode, we focus on two topics combining law and artificial intelligence. The first is the so-called predictive justice. We explain how AI systems try to predict the outcome of court cases, why repeatability of rulings does not always mean accuracy, and the dangers that arise when the results of algorithms begin to resemble court rulings.
The second issue is algorithmic contracts. Professor Pichonnaz talks about the European Law Institute’s work on digital assistants that can enter into contracts on behalf of users. Among other things, we consider what this means for consumers’ freedom of choice, how to understand consent to such a contract, and how to reconcile such solutions with European law.
