Public procurement specialists of DSK Law Firm achieved another success before the National Appeal Chamber.
Our client, a major project company, participated in one of the key tender proceedings for the development of design documentation for the construction of a bridge on one of the largest rivers in Poland and author’s supervision. Its bid was ranked second in the final ranking of bids. DSK Law Firm with the technical support of the Client, successfully questioned the choice of the best bid.
The National Appeal Chamber agreed with the arguments presented by Kinga Kozlowska-Witek of DSK and confirmed that the tenderer selected to carry out the contract misled the contracting authority by indicating that it met the conditions for participation in the proceedings and was not subject to exclusion. Consequently, our client’s bid should have been selected as the most advantageous one.
This settlement is another argument that it is always worth fighting to obtain a contract, and that the formation of an appropriate concept of action allows our client to achieve success.
