In proceedings pending before the EUIPO since 2019, the Office at first instance fully upheld our argument, confirming the competitor’s bad faith and invalidating its mark – despite the expiration of more than 20 years from the filing date.
On appeal, the parties agreed to mediation. The DSK team supported the client in reaching a preliminary agreement, the finalization of which will end the ongoing dispute.
